User Agreement

By subscribing to our services, you agree that all the products and solutions are provided under the conditions specified by the company. This User Agreement constitutes a legal contract between the company and the user.

We guarantee an annual average of 99.9% network availability for the infrastructure of our computer center. If the security of the power supply network or the maintenance of network integrity is in jeopardy, we can temporarily restrict access to the product as required.

The products offered are those valid at the time of the order based on the offer information, the order form and the applicable monthly special offers.

Price and Payment Terms

The current valid prices are accessible at any time at  AvantopPayments are conducted solely when Customer places an order. Invoices are sent by Email as attachments. 

Payments are processed through third-party service providers.

You authorize Avantop to bill your account for any and all charges and fees you incur in connection with the product, including recurring payments.

You are responsible for keeping your account information (including your name, address, account number) on file with Avantop current, and you also authorize Avantop to update your account information with data Avantop obtains from your financial institution.

You authorize the Avantop (i) to retain your account information for as long as is necessary to meet all of your payment obligations to Avantop or until such time as you revoke this authorization in accordance with procedures Avantop provides, whichever is later, and (ii) to share your account and related billing and payment information with companies who work on our behalf, such as payment processors and/or credit agencies, for the purposes of checking credit, effecting payment and servicing your account.

Any revocation by you of this authorization will become effective when all charges and fees associated with your use of the product have been fully satisfied, in our sole discretion.

Your revocation of this authorization will have no effect on your liability for incurred charges and fees through your access to the product.

You must cancel your product prior to your renewal date in order to not incur fees and charges for the following billing cycle.

The Policy of Acceptable Use

This Policy of Acceptable Use is designed to protect the company, its employees, users, partners, affiliates, etc., from malicious, inappropriate, and other kinds unacceptable behaviour from the side of the product users. All the users are subject to the Policy of Acceptable Use.

Domain Registration Agreement

Customers wishing to purchase the products shall agree to the mentioned Domain Registration Agreement. 

As far as the subject of the contractual relationship is concerned regarding the registration of domain names, we conduct the procurement of the desired domain only. For the actual allocation of the domain name, the customer can only expect it if this is confirmed by us. We do not have any influence over the allocation of the domain. A liability and warranty for the actual allocation of ordered domain names is therefore excluded.

Definition of the Withdrawal from the Contract

The right of withdrawal allows the consumer to change his mind about the purchase made, freeing himself from the contract concluded without giving any reason. In this case, the consumer can return the goods and obtain a refund of the amount paid.

The right of withdrawal in e-commerce in the case of service contracts can be exercised from the time of conclusion of the contract. Before the expiry of the withdrawal period, the consumer shall inform of his decision to withdraw from the contract. For this purpose, contact us at Avantop.

Refund Policy

If you have prepaid a 90- or 365- day package, you can cancel service for a partial refund (excluding 30 days) within 14 days from the time of your purchase. After the expiration of 14 days period, the refund is not possible. The refund is not processed for 30 days subscriptions.

Once your cancellation request is received, the refund will be processsed and a credit will be automatically applied to your original payment method within 7 days.

There are no refunds on administrative fees, install fees for custom software, and certain add-on services.

Privacy Information Policy

The Privacy Information Policy regulates the matters connected with collecting, storing, and processing of user information by the company.

1. What personal information do we collect?

When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information or other details to help you with your experience.

We collect information from you when you register on our site, place an order, subscribe to a newsletter, respond to a survey, fill out a form or enter information on our site.

3. How do we use your information?

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

4. How do we protect visitor information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

For your convenience we may store your credit card information kept for more than 60 days in order to expedite future orders, and to automate the billing process.

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

6. Third party links

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

7. General data protection regulation (GDPR)

The General Data Protection Regulation or "GDPR" gives certain rights to individuals in relation to their personal data. Accordingly. Our Account information Settings help users take advantage of those rights. As available and except as limited under applicable law, the rights afforded to individuals are:

• Right of Access - the right to be informed of and request access to the personal data we process about you;

• Right to Rectification - the right to request that we amend or update your personal data where it is inaccurate or incomplete;

• Right to Erasure - the right to request that we delete your personal data;

• Right to Restrict - the right to request that we temporarily or permanently stop processing all or some of your personal data;

• Right to Object - the right, at any time, to object to us processing your personal data on grounds relating to your particular situation; the right to object to your personal data being processed for direct marketing purposes;

The Policy of Copyright Claims provides the needed information connected with claims on intellectual property infringements on the websites hosted on our servers.

What to include in your complaint

To help us review and resolve your complaint as quickly as possible, make sure to include the following:

• Your name

• The email address you use to sign in to Avantop

• Your telephone number, including dialing code

• A clear description of your complaint

• Your status as either:
- A private consumer
- A representative of a business which employs fewer than 10 persons and has an annual turnover or balance sheet of €2 million or less
- A representative of a charity which has an annual income of less than £6.5 million
- A trustee of a trust which has a net asset value of less than £5 million
- None of the above

Response time

We try to confirm that we've received your complaint within one business day, and to respond to your complaint within 3 business days.

In our response, we tell you how your complaint has been addressed, or why it couldn't be addressed yet. Then, we inform you of what the next steps are.

Escalating complaints

Our aim is to resolve your complaint quickly and completely. If, for any reason, you aren’t satisfied with our response, your case can be reviewed at a higher level. Simply ask the Avantop specialist handling your complaint to escalate the complaint for you. The escalation of your complaint will be acknowledged within 5 business days.

Contract duration/cancellation

Where not otherwise contractually agreed, the contracts are in place for an indefinite period of time. The contract is cancellable without giving reasons by both parties at any time during a period of 30 days to the end of the month, but at the earliest on expiry of the minimum contract period stipulated in the contract. A cancellation can be done in writing by letter, fax, email or via the secure online administrations interface, provided.
